1. Agreeing to these terms
Xinsto Extension (“the service”, “we”, “us”) is run by NodeSpace Technologies, LLC. These Terms of Service are an agreement between you and us. By creating an account, or by using the service at all, including just viewing profiles, you agree to them. If you don't agree, please don't use the service.
Our Privacy Policy explains what information we collect and what we do with it. It's part of these terms.
2. Who can use Xinsto Extension
- You must be at least 13 years old to create an account. If the law where you live sets a higher age for using a service like this without a parent's permission, you must meet that age or have that permission.
- You can't use the service if we've previously suspended or deleted your account for breaking these terms, unless we've told you otherwise.
- If you use the service on behalf of a group, club or business, you're agreeing to these terms for it too, and you're confirming you're allowed to.
3. Your account and access name
- Give us a real email address that you control. We use it to activate your account and to contact you about it. Your first and last name should be your own, not someone else's.
- Keep your password to yourself. You're responsible for what happens under your account. If you think someone else has got into it, change your password in Studio X and tell us.
- Your access name is part of your profile link. We may take back or change an access name that impersonates someone, infringes a trademark, is offensive, or belongs to an account that was deleted or suspended. Once you change or give up an access name, someone else may claim it.
- One person may have more than one account, but not to dodge a suspension, to impersonate others, or to spam.
4. Your content
“Your content” means everything you put into Xinsto Extension: your profile's HTML, CSS and JavaScript, your title, your away message, your colours, and anything else you add.
- You keep ownership. We don't claim ownership of your content.
- You give us permission to run the service with it. You grant us a worldwide, non-exclusive, royalty-free license to store, copy, display, format and send your content, only as needed to operate, secure, back up and improve Xinsto Extension. This includes showing your profile to anyone who visits it while it's public, and showing your title and access name in lists like “Recently updated profiles”. The license ends when you delete the content or your account, except for copies in backups, which are overwritten on their normal schedule, and anything we must keep for legal reasons.
- Public means public. Unless you set your profile to private in Studio X, anyone on the Internet can see it, and anyone who sees it can copy it. Don't put anything on your profile you wouldn't want the whole world to see, like your home address, phone number or passwords.
- You're responsible for it. You promise you have the right to post your content, including any images, music, code or text made by someone else, and that it follows these terms and the law. We don't check content before it goes up.
5. The rules
Be cool, follow the rules & don't ruin it for everyone else. You may not use Xinsto Extension to post, link to, or do any of the following:
- Attacks on people or computers: malware, viruses, exploits, cryptocurrency miners, scripts that try to break out of the profile sandbox, or anything that tries to break, overload or get unauthorized access to the service, another site, or anyone's device or account.
- Tricking people: phishing, fake login or payment forms, scams, or pages pretending to be another company, site or official service.
- Spying on visitors: collecting visitors' personal information without telling them clearly, or tracking them in ways they haven't agreed to.
- Harassment and hate: threats, bullying, stalking, or attacks on people based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation or age.
- Other people's private information: posting someone's private details (like their home address, phone number, or private photos) without their permission.
- Impersonation: pretending to be another person or organization in a misleading way. Clearly labeled parody and fan pages are fine.
- Sexual content: pornography or sexually explicit material. Xinsto Extension is open to teenagers.
- Anything that sexualizes or endangers children. We remove it, delete the account, and report it to the authorities.
- Violence and self-harm: content that promotes or glorifies violence, terrorism, or self-harm.
- Illegal content or activity: including selling illegal goods or services.
- Infringement: content that infringes someone's copyright, trademark or other rights.
- Spam: bulk or repetitive advertising, link farms, or accounts made mainly to promote something.
We decide whether something breaks these rules, and we may act on things these rules don't list if they harm people or the service.
6. Scripts and the sandbox
You can use JavaScript on your profile. Your profile runs in a sandboxed frame that is kept separate from the rest of Xinsto Extension, so its scripts can't read anyone's login or reach Studio X. You agree not to try to get around that sandbox or any other security measure. If you find a security problem, please tell us at [email protected] instead of using it, and we'll be grateful.
Scripts and embeds you add can load things from other websites. You're responsible for what they do, and for following those websites' terms.
7. Reports, moderation and suspension
- Anyone can report a profile using the “Report” link at the top of it. Our admins review reports, but we don't promise to review every report within any particular time, and we're not required to monitor content.
- If we believe you've broken these terms, or that your content puts people or the service at risk, we may, without notice: make your profile private, reset your profile content, change your access name, suspend your account, or delete it. Admins may also keep private notes about your account to help with moderation.
- A suspended account can't log in, and its profile shows that it has been suspended. When we suspend an account, we try to give a reason, which you'll see when you try to log in.
- If you think we got it wrong, email us at [email protected] and we'll take another look.
8. Copyright complaints
We respect copyright and expect members to do the same. If you believe content on Xinsto Extension infringes your copyright, send a notice to [email protected] that includes:
- your physical or electronic signature;
- a description of the copyrighted work you believe was infringed;
- the profile link (and where on the page) of the material you want removed;
- your name, address, phone number and email address;
- a statement that you believe in good faith that the use isn't authorized by the copyright owner, its agent, or the law; and
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for them.
If your content was removed because of a notice and you believe that was a mistake, you can send a counter-notice to the same address. It needs your signature, a description of what was removed and where it was, a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification, your name, address and phone number, and a statement that you consent to the jurisdiction of the appropriate court and will accept service from the person who sent the original notice.
We delete the accounts of members who repeatedly infringe others' copyrights.
9. Deleting your account
You can delete your account at any time in Studio X under Your Information. This deletes your account and profile right away. The Privacy Policy explains what, if anything, is kept afterward. You can also download a copy of your information there first.
We may delete accounts as described in section 7, and we may delete accounts that were never activated.
10. The service itself
- Xinsto Extension is free. If we ever want to charge for something, we'll tell you first, and you won't be charged for anything you didn't agree to pay for.
- We may add, change or remove features, and we may stop running the service. If we plan to shut it down, we'll try to give at least 30 days' notice through a Service Announcement or on the site so you can save your content.
- The Xinsto name, logos and the design of the site belong to us. These terms don't give you any rights to them, except to link to your profile.
11. Disclaimers and limits of liability
Xinsto Extension is a free service provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the service will always be available, secure or free of errors, or that your content won't be lost. Keep your own copy of anything important.
Profiles are made by members, not by us. We aren't responsible for members' content or for other websites that profiles link to or load content from.
To the fullest extent the law allows, NodeSpace Technologies, LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of, or inability to use, the service. Our total liability for any claim related to the service is limited to US $50.
Some places don't allow some of these limits. If you live in one, the limits apply only as far as your local law allows, and nothing in these terms takes away rights you have that can't legally be waived.
12. Your responsibility to us
If someone makes a claim against us because of your content or because you broke these terms or the law, you agree to cover our reasonable costs of dealing with it, including legal fees, to the extent the law allows.
13. Changes to these terms
We may update these terms from time to time. The date at the top shows when they last changed. If we make a change that matters, we'll let members know with a Service Announcement in Studio X or a notice on the site before it takes effect. If you keep using the service after a change takes effect, you're agreeing to the new terms. If you don't agree, you can delete your account.
14. Governing law
These terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law rules. Any dispute about them or the service will be handled in the courts located there, unless the law where you live gives you the right to bring it somewhere else.
If any part of these terms turns out to be unenforceable, the rest still applies. If we don't enforce a part of these terms right away, we haven't given up the right to enforce it later. These terms, together with the Privacy Policy, are the whole agreement between you and us about the service.
